A BILL to amend article seven, chapter sixty-one of the code of
West Virginia, one thousand nine hundred thirty-one, as
amended, by adding thereto a new section, designated section
eleven-b, relating to creating misdemeanor of threatening to
bring deadly weapon on school property for purpose of harming
any school employee or student.
Be it enacted by the Legislature of West Virginia:

That article seven, chapter sixty-one of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section
eleven-b, to read as follows:
ARTICLE 7. DANGEROUS WEAPONS.
§61-7-11b. Threatening to bring deadly weapon to school to harm
any school employee or student is a misdemeanor;
penalties.

It is unlawful for any person to make a credible threat to
bring a firearm, other dangerous weapon or other dangerous device
upon school property for the purpose of harming any school employee
or student. A person violating the provisions of this section is
guilty of a misdemeanor and, upon conviction thereof, shall be
fined no more than one thousand dollars, or confined in a county or
regional jail no more than one year, or both fined and imprisoned.

NOTE:
The purpose of this bill is to create a misdemeanor
offense of threatening to bring a dangerous weapon on school
property for the purpose of harming a school employee or student.
